Subject matter: The present general terms and conditions of sale have the purpose, firstly, to inform any potential customer of the conditions and modalities under which the seller proceeds with the sale and shipping of products ordered, and furthermore, to define the parties’ rights and obligations as part of the products’ sale by the seller to the customer. They apply, without restriction or reserve, to all sales, by the www.boutique-electroconcept.com  company, to products proposed on its website \» www.Boutique-electroconcept.com \».

Therefore, the fact for every person to order a product proposed for sale on the website of the www.boutique-electroconcept.com company takes full and whole acceptance of the present general terms and conditions of sale of which the customer acknowledges being acquainted with before his order. The customer, beforehand his order, declares to have full legal capacity, allowing himself to commit in accordance with the present general terms and conditions of sale. Formation of the contract and orders: Price: Sale prices of online products on the www.boutique-electroconcept.com website, indicated in Euros, are those in force at the time of the order form registration by the customer. Sale prices include shipping charges except for flight-cases and speakers (please contact us Tel 04 69 66 56 22). Shipping costs will be invoiced in supplement of the purchased products’ prices, according to the amount of the order. Shipping charges will be displayed before the order registration by the customer. Sale prices are all taxes included; they include value added tax (VAT) applicable on the day of the order and any change to the applicable VAT rate will automatically come into effect on the price of products sold by www.boutique-electroconcept.com within its website. Order: Any order implies acceptance without restriction or reserve to the present general terms and conditions of sale. Once the customer registers his order by clicking the \» Confirm your order \» icon, he is considered to have knowingly and without reserve accepted the present general terms and conditions of sale, as well as the prices, amount and quantities of the products proposed for sale and ordered. The sale will only be considered as final after the customer has been sent the order confirmation by www.boutique-electroconcept.com, and after www.boutique-electroconcept.com has collected the total price. www.boutique-electroconcept.com advises the customer to keep these details on a paper or computer file.

 

Price and payment terms: Payment of the total price must be done throughout the customer’s order. The amounts paid cannot be considered as deposits or advances at any time.  All orders are due in Euros. To pay his order, the customer may choose from all payment methods indicated within the order form, by bank or postal check. The customer ensures to www.boutique-electroconcept.com that he has all the authorizations required to use the payment method he has chosen throughout the order form registration.  www.boutique-electroconcept.com reserves the right to suspend or cancel any order and/or shipping, no matter their nature or execution level, in case of non-payment of any amount due by the customer, or in case of payment incident. Penalties of an amount equal to the legal interest rate increased by five points are applicable by full right to unpaid amounts at the end of a period of ten days from the invoice date or immediately after notification of rejected bank payment for all other payment methods. Shipping of all new order may be suspended in case of payment delay for previous order notwithstanding the provisions hereof. www.boutique-electroconcept.com reserves the right to ask for a photocopy of the identity card of the customer for all payment made by credit card. Sending a photocopy of the identity card is mandatory when the payment is made by check by the consumer.  In accordance with the fight against fraudulent activities on the Internet, order information might be communicated to any third party for verification.

 

Product selection: The customer, being acquainted with the products and their characteristics, marketed by www.boutique-electroconcept.com, has under his sole responsibility and in accordance with his needs which he already determined before any order, selected one or several products constituting his order. In addition, only the customer is acquainted with the hardware, software, and other settings he uses, and he is the sole judge of the ordered products’ compatibility with his own setup. It is the customer’s entire responsibility to seek advice where he lacks necessary expertise.

 

Delivery and receipt: general rules: Products will be delivered to the address indicated on the order form by the customer, in metropolitan France and Corsica. The customer has the option, at his express request, to have the invoice sent to the invoicing address and not the shipping address, by checking the appropriate option on the order form. As far as shipping is concerned, we work with La Poste, the French postal service provider, and TNT Express. To reduce delivery lead times, we dispatch your order via “colissimo suivi” and TNT Express home delivery services (if the customer is absent at the time of the delivery, he can pick up his order in a pick-up location.)

The “Colissimo Suivi” service from the French Post Office has the following features:  the customer can collect the ordered products at the nearest post office from the shipping address, in the event of an absence to the shipping location during the presentation of the postman. The customer has his order delivered by the postman at home and has to sign a delivery note with acknowledgment of receipt. In the event of an absence, the customer or addressee of the ordered product receives from the postman a delivery notification, which allows him to pick up the ordered products at the nearest post office, within fifteen days. The Seller delivers only in metropolitan France, including Corsica. We reserve the right to cancel or refuse any order involving shipping to an address located outside this territory.

 

Specific case: French Overseas Departments and Territories shipping: free shipping for any order higher than 100 euros doesn’t apply.

 Customs clearance is the responsibility of the customer.

 Specific case OUTSIDE METROPOLITAN FRANCE shipping: free shipping for any order higher than 100 euros doesn’t apply.

Specific case PROFESSIONNAL CUSTOMERS, RESELLERS IN FRANCE: order threshold of free shipping is set to 400euros.

Specific case PROFESSIONNAL CUSTOMERS, RESELLERS IN EUROPE AND INDIVIDUALS IN EUROPE: order threshold of free shipping is set to 500euros.

    Customs clearance is the responsibility of the customer.

 

 

Shipping issues: the customer is bound to examine, in the presence of the post office attendant or the representative from TNT Express, the condition of the goods’ packaging and its content upon delivery. Should it be that the customer would have any doubt of any kind whatsoever on the condition or content of the parcel, he is bound to:

- apply the Colissimo procedure (including reporting payable losses, any claims and reserves) and refuse the goods by immediately issuing a fault report with the French Post Office attendant (report170).

- To report these incidents to www.boutique-electroconcept.com via registered letter with acknowledgment of receipt, to the address indicated in paragraph 2 hereof, within 7 days from the refusal of the goods by the customer, this happens by stating the said claims and reserves. Failure to comply with the procedure displayed above will imply a non-acceptance for any claim made by the customer.

 

Late Delivery: The “Colissimo Suivi” service from the French Post Office and TNT Express or Express home-based from TNT EXPRESS allows for shipping within an average delay of forty-eight hours from the www.boutique-electroconcept.com warehouse departure. The departure order is given by www.boutique-electroconcept.com after full collection of the order’s price. This delay is intended as indication only. Any eventual exceeding time will not result in damages, withholding or invalidation of the order by the customer. In any case, and in accordance with the provisions of article L 121.20.3 of the French Consumer Code, the delivery of your online purchase must be completed within thirty days from the day following the day the customer registered his order, subject to full payment of the price. Failure of shipping within this specified period will give the customer the possibility to cancel his order.The amounts paid by the customer will be refunded without delay, excluding any indemnities. In the event of a shipping delay compared to the date initially set, the customer will have to notify the fact in writing (post, fax, mail) to www.boutique-electroconcept.com , in order to improve the service quality which might be offered to him, and to allow www.boutique-electroconcept.com to proceed with an inquiry at the French Post Office. An inquiry at the French Post Office can last up to 21 business days. If the product is located within this delay, it will immediately be sent again to the customer’s home or the addressee’s designated in the order form. However, if the ordered product is not retrieved by the end of these 21 days of inquiry period, www.boutique-electroconcept.com will proceed at its own expense to a new shipment of products ordered by the customer. Should it be that the ordered product would be unavailable, we will proceed to the refund. In case of product exchange, shipping costs will be charged to the customer.

 

Products availability: In case one of the products ordered is unavailable, www.boutique-electroconcept.com will inform the customer as soon as possible. In accordance with the provisions of article L121.20.3 of the French Consumer Code, Electroconcept SARL will be able to provide, in that case, a product of equal price and quality. Shipping costs will then be charged to www.boutique-electroconcept.com. If it’s impossible www.boutique-electroconcept.com to make use of this option, the customer will be refunded without delay and no later than thirty days of the paid amounts.

 

Withdrawal rights: In accordance with article L121.20 of the French Consumer Code, the customer has a seven clear days delay from the date of delivery, to return at his own expense the ordered products, for exchange or refund. Products must imperatively be returned to www.boutique-electroconcept.com in perfect condition for resale, in their condition of origin (packaging, accessories, notice), duly sealed. Any partial, dented, damaged product or of which the original packaging has been damaged, will not be refunded or exchanged. In any case the product cannot be returned before the attribution of a return number by the customer service of www.boutique-electroconcept.com

 

Withdrawal penalties after delivery, for cancellation or exchange or change of the totality or a part of an order: Penalty consists of:

- Penalty of a 10euros minimum flat rate for processing fees increased by a penalty of 0 to 30%, or more, for variable depreciation according to the equipment’s condition after expertise.

- Shipping costs’ increase for the shipping costs’ value already engaged for the first shipping (only in case of order cancellation and for an order in France).

- Reshipping costs of new products remain at the customer’s own expense.

- The penalties’ total can’t be lower than 10 euros.

Cancellation or exchange: cancellation or exchange is impossible for any order regarding a special article, customized equipment or articles upon request.

 

General conditions of refund: Any refund at Electroconcept own expense will be made by check. By the very fact of presenting the check for cashing, the consumer pledges on his honor not to make any objection or opposition to his bank or any other means, to the transaction concerned by the refund, and pledges not to do so within a year delay following the presentation’s date of the check. The consumer acknowledges being acquainted with the fact that any failure to meet this requirement shall expose him to the retrocession of the unduly received amount, without prejudice to any damages which may be claimed by Electroconcept. The customer will be refunded within a maximum delay of 30 business days from the date of the return of the product, based on the price of the invoiced product listed on the order summary and the preparation and shipping costs actually paid by the customer, net if need be of granted discounts to the customer throughout his purchase.

Retention of ownership: products sold remain the exclusive property of www.boutique-electroconcept.com until the full collection of the price, in principal, costs and taxes included.

 

Warranty: Some sold products have a 2-year warranty from the manufacturer, of which general conditions differ from one supplier to another. General conditions and warranty period are available on the www.boutique-electroconcept.com website. The customer shall be deemed to have consulted and agreed these general conditions and warranty period. Any product returned under the aforesaid warranty must be subject to a prior agreement of www.boutique-electroconcept.com. For this purpose, the customer shall contact the customer service of www.boutique-electroconcept.com. No return will be accepted without prior authorization of www.boutique-electroconcept.com. If the product is identified as defective, www.boutique-electroconcept.com will pass on to the buyer a product return number. This return number is an essential and critical condition, and is valid for seven business days, from the notification of the return number by www.boutique-electroconcept.com to the customer. After this period, the customer shall renew his request, according to the above described procedure. The defective product must be returned in its original packaging, including the whole product and its accessories, and be accompanied in a legible manner by the product return number given by www.boutique-electroconcept.com and the product serial number. Any partial, dented, damaged product, and/or of which the original packaging has been damaged, will not be returned or exchanged as part of warranty. Any costs and risks associated with the product’s return are at the customer’s own expense. Product under warranty will be, at the manufacturer’s discretion, exchanged or repaired. www.boutique-electroconcept.com does not ensure the customer, under hidden defects that may affect delivered product, in the case of the replacement of defective products, or parts making the product unfit for its use, without being able to be considered by the customer as responsible for the possible harmful consequences that these hidden defects may have caused.

 In any events, warranties don’t cover:  replacement of consumables, abnormal and improper use of the products, defects and their consequences due to the intervention of the customer or repair technician not approved by www.boutique-electroconcept.com, defects and their consequences related to improper use regarding the utilization to which the product is intended (professional use, collective use), products subject to a specific support and maintenance contract.

 

Responsibility: Offered products by www.boutique-electroconcept.com are in compliance with the French legislation in force. Electroconcept shall not be held responsible for the failure to perform a contract in case of a stock shortage or the unavailability of the product, in case of force majeure, disturbance or total or partial strike, notably strike of postal services and means of transports and/or communication. Electroconcept shall not be held responsible for any indirect damages which may occur as a result of products’ purchase. The total or partial impossibility to use the products, notably due to equipment incompatibility, shall not engage the responsibility of de www.boutique-electroconcept.com nor result in any compensation or refund. The www.boutique-electroconcept.com website contains information from third parties, as well as links to other websites. www.boutique-electroconcept.com shall not, in any case, be held responsible for damages resulting from the use, the access to, or the inability to use this third information, nor the content of other websites.

 

Partial non-validity: If one or more provisions of these general terms and conditions of sale are regarded as invalid or declared as such by the application of a law, a regulation or following a final decision from a competent jurisdiction, other provisions shall remain in force to their full extent.

 

Non-waiver: The fact for one of the parties not to take advantage of a breach, from the other party, to any of these obligations referred to within these general terms and conditions of sale hereof shall not be construed for the future as a waiver regarding the obligation in question.

 

Applicable law: sales’ products of the www.boutique-electroconcept.com company are subject to French law.

 

Information technology and freedom: collected information by www.boutique-electroconcept.com during any customer’s order is necessary for the management of the order by www.boutique-electroconcept.com and its trading partners. In accordance with the French Data Protection and Freedom of Information Law of January 6, 1978 (loi Informatique et Liberté n°78-17 du 6 janvier 1978), the customer has a right of access, rectification, opposition or deletion to his personal data with www.boutique-electroconcept.com.
